Why we need to include them at all –
Why can’t we rely solely on what’s in the Trusts Act 1973?
Why do we need them in a will?
Practical examples of particular trust powers in wills/deeds and why they should be used and what could happen if they are not, including:
(a) what are the particular positive and negative features of the powers as contained in the legislation;
(b) which ones in their legislative form, are adequate, which ones are inadequate, and how might they be modified;
(c) what happens if powers are not included;
(d) why do we need to include any trust powers in the documents that we draft, given what is in the legislation.
